These Terms of Service ("Terms") govern all services provided by TrustedBoosts, operated by Sascha Wohlert ("we," "us," "our"). By accessing, using, or purchasing our services, you ("Customer," "you") unconditionally accept and agree to be bound by these Terms in their entirety.

IMPORTANT: Our services involve reputation management and review optimization on third-party platforms. Results cannot be guaranteed, and we assume NO LIABILITY for platform changes, review removals, or business outcomes.

2. Service Description

TrustedBoosts provides legitimate reputation management services exclusively through compliant methods. Our services include:

  • Review management strategy consultation and implementation
  • Response management for existing reviews
  • Customer communication optimization
  • Trustpilot profile optimization within platform guidelines
  • Review analytics, reporting, and monitoring
  • Process improvement recommendations
  • Customer service training and guidance
  • Compliance consulting for platform policies

WE STRICTLY DO NOT: Create fake reviews, manipulate ratings through deceptive practices, violate platform terms, engage in review fraud, purchase reviews, or participate in any form of artificial rating manipulation.

3. Platform Compliance and Legal Conformity

All services are provided in strict compliance with:

  • Trustpilot's Terms of Service and Community Guidelines
  • German law, including UWG (Unfair Competition Act)
  • EU regulations on consumer protection and digital services
  • GDPR and applicable data protection laws
  • Platform-specific policies of all review platforms
  • German Civil Code (BGB) provisions
  • Distance Selling Regulations (Fernabsatzrecht)
  • Consumer Protection Laws (Verbraucherschutzgesetze)

Customer Responsibility: You warrant that your business activities and requested services comply with all applicable laws and that you operate a legitimate business with real customers.

4. RIGHT OF WITHDRAWAL (WIDERRUFSRECHT)

IMPORTANT FOR GERMAN CONSUMERS

Express Waiver Required: By purchasing our services, you expressly agree that service delivery begins immediately upon purchase completion.

Withdrawal Rights: You have the right to withdraw from this contract within 14 days without giving reasons. The withdrawal period expires 14 days after the day of contract conclusion.

HOWEVER: By agreeing to immediate service commencement during the purchase process, you acknowledge that:

  • Services begin immediately upon payment confirmation
  • You expressly waive your right of withdrawal for services already performed
  • Once services have commenced, withdrawal rights are forfeited
  • Digital content delivery constitutes complete performance

5. Customer Obligations and Warranties

You agree to and warrant:

  • Provide accurate, complete, and truthful business information
  • Comply with all platform terms of service and community guidelines
  • Not request any services that violate laws or platform policies
  • Maintain confidentiality of account credentials and access information
  • Respond promptly to customer inquiries and service-related communications
  • Notify us immediately of account suspensions, warnings, or policy violations
  • Accept full responsibility for your business practices and customer interactions
  • Not engage in any form of review manipulation or fraud
  • Maintain honest business practices and accurate product/service descriptions
  • Handle customer complaints professionally and in good faith
  • Not use our services to circumvent legitimate customer feedback
  • Comply with all applicable consumer protection laws

Business Legitimacy Warranty: You warrant that your business is legitimate, products/services are as described, you have proper business licenses, and you have not engaged in deceptive, fraudulent, or illegal practices.

6. NO WARRANTIES AND RESULTS DISCLAIMER

IMPORTANT: READ THIS SECTION CAREFULLY

COMPLETE WARRANTY EXCLUSION: We provide services on an "AS IS" and "AS AVAILABLE" basis without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for purpose, or non-infringement.

NO GUARANTEES WHATSOEVER FOR:

  • Improvement in review scores, ratings, or rankings
  • Increase in number of reviews or customer feedback
  • Business growth, revenue increases, or profit improvements
  • Continued availability or functionality of third-party platforms
  • Platform policy stability, compatibility, or algorithmic consistency
  • Account standing, compliance status, or platform relationships
  • Competitive advantages or market position improvements
  • Customer satisfaction or business reputation outcomes
  • Return on investment or measurable business results
  • Compliance with future platform policy changes

RESULTS VARIABILITY: Success depends on numerous factors including your business quality, customer satisfaction, market conditions, platform changes, competitive dynamics, economic factors, and circumstances entirely beyond our control or influence.

7. COMPREHENSIVE LIABILITY LIMITATION

MAXIMUM LEGAL LIABILITY EXCLUSION UNDER GERMAN LAW

TO THE FULLEST EXTENT PERMITTED BY GERMAN LAW:

  • NO LIABILITY for review removals, deletions, modifications, or filtering by platforms
  • NO LIABILITY for account suspensions, restrictions, warnings, or platform penalties
  • NO LIABILITY for platform policy changes, guideline updates, or algorithmic modifications
  • NO LIABILITY for loss of business, profits, revenue, opportunities, or competitive position
  • NO LIABILITY for indirect, consequential, punitive, special, or incidental damages
  • NO LIABILITY for third-party actions, decisions, technical issues, or competitive behavior
  • NO LIABILITY for data loss, system downtime, technical failures, or service interruptions
  • NO LIABILITY for market changes, economic factors, or industry developments
  • NO LIABILITY for customer complaints, negative feedback, or reputation damage
  • NO LIABILITY for legal costs, regulatory actions, or compliance failures

MAXIMUM LIABILITY CAP: Our total aggregate liability for any and all claims, regardless of cause, theory of liability, or damages sought, shall not exceed the lesser of: (a) the amount paid by you for services in the 30 days immediately preceding the claim, or (b) €100.

STATUTORY LIABILITY: Nothing in these Terms excludes liability for death, personal injury, fraud, or other matters where liability cannot be excluded under German law.

8. Platform Risks and Third-Party Dependencies

YOU ACKNOWLEDGE, UNDERSTAND AND ACCEPT:

  • Review platforms operate independently with proprietary policies and algorithms
  • Platforms may change policies, guidelines, or functionality without notice
  • Reviews may be removed, filtered, modified, or hidden by platforms at their discretion
  • Platform algorithms and ranking systems are proprietary and subject to change
  • Account restrictions, suspensions, or penalties may occur despite compliance efforts
  • Platform technical issues may affect review visibility, functionality, or accessibility
  • Competitor actions, market forces, or industry changes may impact your standing
  • Economic, regulatory, legal, or industry changes may affect platform operations
  • Platform mergers, acquisitions, or business changes may affect service availability
  • Geographic restrictions or legal requirements may limit platform functionality

COMPLETE RISK ASSUMPTION: You assume all risks associated with platform dependencies, third-party actions, and factors beyond our control.

9. Payment Terms and Refund Policy

Payment Terms: All prices are in EUR and include applicable German VAT. Payment is due immediately upon purchase for one-time services, or according to subscription terms for recurring services. We accept major payment methods through secure payment processors.

ABSOLUTE NO REFUND POLICY: Due to the immediate digital nature of our services, ALL SALES ARE FINAL AND NON-REFUNDABLE. No refunds, chargebacks, credits, or compensation will be provided under any circumstances, including:

  • Dissatisfaction with results, outcomes, or service quality
  • Platform policy changes, account issues, or technical problems
  • Review removals, rating changes, or algorithmic updates
  • Business performance issues or competitive factors
  • Technical issues, service interruptions, or downtime
  • Changes in business needs or strategic direction
  • Economic conditions or market changes
  • Legal or regulatory changes affecting your business
  • Force majeure events or unforeseeable circumstances

Payment Disputes: Any payment disputes must be resolved directly with us before initiating chargebacks. Fraudulent chargebacks may result in legal action and additional fees.

10. German Law Compliance and Consumer Rights

BGB Compliance: These Terms comply with German Civil Code (BGB) requirements while maximizing permissible liability limitations.

Consumer Protection: If you are a consumer under German law, certain mandatory rights cannot be excluded. However, to the extent permitted, we limit liability for business-related damages and indirect consequences.

Unfair Contract Terms: These Terms have been drafted to comply with German unfair contract terms legislation (AGB-Recht) while providing maximum legal protection.

11. Intellectual Property and Confidentiality

Our Intellectual Property: All methodologies, strategies, reports, software, algorithms, processes, and materials remain our exclusive intellectual property. You receive only a limited, revocable, non-exclusive license for personal business use.

Confidentiality: Both parties agree to maintain strict confidentiality of proprietary information, including strategies, methodologies, account details, business data, and any non-public information exchanged.

Restrictions: You may not copy, distribute, modify, reverse-engineer, or create derivative works from our intellectual property.

12. Service Termination and Suspension

Immediate Termination Rights: We may terminate or suspend services immediately without notice or refund for:

  • Violation of these Terms or applicable laws
  • Non-payment, payment disputes, or fraudulent payment activities
  • Platform policy violations, account suspensions, or compliance issues
  • Requests for illegal, unethical, or policy-violating services
  • Abusive, threatening, or inappropriate behavior toward our staff
  • Any action that risks our business, reputation, or legal standing
  • Providing false or misleading information
  • Attempting to circumvent these Terms or our policies

No Compensation on Termination: Termination does not entitle you to refunds, compensation, or damages of any kind.

13. Indemnification

CUSTOMER INDEMNIFICATION OBLIGATION: You agree to indemnify, defend, and hold harmless TrustedBoosts, Sascha Wohlert, and all associated parties from any and all claims, damages, losses, costs, and expenses (including reasonable attorney fees) arising from:

  • Your use of our services or violation of these Terms
  • Your business practices, customer interactions, or service delivery
  • Platform policy violations, account issues, or compliance failures
  • Third-party claims related to your business, products, or services
  • Legal violations, regulatory non-compliance, or governmental actions
  • Breach of warranties or misrepresentation of facts
  • Intellectual property infringement claims
  • Data protection or privacy law violations

14. Force Majeure and Unforeseeable Events

We are not liable for service delays, interruptions, or failures caused by events beyond our reasonable control, including but not limited to:

  • Platform outages, policy changes, or technical failures
  • Government regulations, legal restrictions, or court orders
  • Natural disasters, pandemics, emergencies, or acts of God
  • Internet failures, cyber attacks, or security breaches
  • Labor disputes, supplier failures, or vendor issues
  • Economic crises, market disruptions, or currency fluctuations
  • War, terrorism, or political instability

15. Governing Law and Dispute Resolution

German Law: These Terms are governed exclusively by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict of law principles.

Jurisdiction: The exclusive place of jurisdiction for all disputes is Passau, Germany. For consumers, statutory jurisdiction rules may apply.

Dispute Resolution: We encourage resolution of disputes through direct communication. We do not participate in alternative dispute resolution procedures unless legally required.

16. Modifications and Severability

Terms Modifications: We reserve the right to modify these Terms at any time with reasonable notice. Continued use constitutes acceptance of modified Terms. Material changes will be communicated via email or website notice.

Severability: If any provision is deemed invalid or unenforceable, it shall be modified to the minimum extent necessary to make it valid, and all remaining provisions remain in full effect.
